Scot, you have two interesting stories on your blog that illustrate eBay's predicament. On the one hand, they are claiming they are only a 'venue' - meaning they only provide web space for customers to 'park' their listings. Therefore, they shouldn't be held accountable for what is on their site. (The German ruling must have them sweating profusely!)
Yet, on the other hand, they are practicing censorship by unilaterally decided what words can or cannot be used on their site.
Seems like quite a contradiction. eBay wants to have it both ways which is going to be an increasingly difficult position to maintain. It will be fascinating to see what the future brings.
